 11/25/2009 – 6/29/09 England v Kramer Wrongful Death Settlement: $257,000

Defendant in this action suffered a heart attack and crossed over into opposing traffic and hit our client head on.  The police on immediately began to treat the driver of the other vehicle as if he was not at fault or that maybe the motorcycle rider was somehow at least partially responsible for the accident.  Witnesses were identified but not interviewed. 

The decedent’s wife had hired an attorney who never met with the widow so she contacted our office for further handling of the claim.  Our investigators were able to locate and interview all of the relevant witness and once we had put together the correct version of this accident, we presented it to the insurance carrier.  Our efforts were enough and we were able to prove to the carrier that their insured was at fault for the loss and that they needed to immediately pay the policy limits.
